These Terms of Service (the “Terms”) govern your access to and use of the Travel INGON App and the website www.ingon.ca (together, the “Service”), operated by Travel-ING On Tourism Cooperative (“we”, “us”, “our”). By creating an account, installing the App, or using the Website, you agree to these Terms. If you do not agree, do not use the Service.

 

1. Description of Service

Travel INGON helps users discover historical points of interest, capture location-based selfies, complete challenges, read heritage articles, and connect with local tourism and heritage organizations in Alberta. The Website additionally provides membership sign-up, donations, workshop/webinar registration, and a form to submit heritage information for review.
 

2. Eligibility

The Service is not directed to children under 13, and you must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian.

 

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when signing up, whether directly, via Facebook Login, or via Google Sign-In. Notify us promptly at administration@ingon.ca if you suspect unauthorized use of your account.

 

4. Acceptable Use

You agree not to:

• Submit false, misleading, unlawful, defamatory, or infringing information, images, or challenge answers

• Damage, deface, or endanger yourself or others at any historical site or point of interest

• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems

• Use the Service for any purpose that is unlawful or prohibited by these Terms

• Interfere with or disrupt the operation of the Service

5. Your Submissions and Content

When you submit photos, selfies, or heritage information through the App or the Website's “Suggest Information” feature, you confirm you have the right to submit that content and grant us a non-exclusive, royalty-free license to use, reproduce, and display it in connection with operating and promoting the Service. Heritage submissions are reviewed by us before any public use; we may decline to publish a submission at our discretion.

 

6. Facebook Login, Google Sign-In, and Third-Party Services

If you choose to sign in with Facebook or Google, your use of that login is also subject to that provider's own terms of service. We are not responsible for the availability or practices of Facebook, Google, or any other third-party service (including Wix, Google Forms, Zoom, or Google Maps) integrated with the Service.

 

7. Membership and Donations

Lifetime membership is available via the Website for a one-time fee. Donations made through the Website (whether online, by e-transfer, or by cheque) are voluntary and non-refundable except where required by law. We are not a payment processor; any online payment is handled by our website platform or a designated third-party processor.

 

8. Sponsors and Third-Party Links

The App may display information about sponsors and partner organizations, and the Service may link to third-party websites. We do not endorse, and are not responsible for, the content, products, or practices of any sponsor or linked third-party site.

 

9. Intellectual Property

The Service, including its text, graphics, logos, and software (excluding content you submit), is owned by or licensed to Travel-ING On Tourism Cooperative and is protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

 

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that historical information provided is complete or free of error.

 

11. Limitation of Liability

To the maximum extent permitted by law, Travel-ING On Tourism Cooperative shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any injury sustained while visiting a point of interest referenced in the App.

 

12. Termination

We may suspend or terminate your access to the Service at any time for conduct that violates these Terms or is otherwise harmful to other users or the Service. You may stop using the Service, or request deletion of your account, at any time – see our Data Deletion Instructions.

 

13. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

 

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
